ODM dismisses Jumwa, Dori appeal to be allowed back to party

The Orange Democratic Movement (ODM) has dismissed an appeal by Malindi MP Aisha Jumwa and Suleiman Dori of Msambweni calling for their reinstatement.

In a statement on Wednesday, the ODM Secretary General Edwin Sifuna said the party Constitution does not allow appeals after expulsion.

“It is frankly embarrassing for your clients to claim to be ‘champions of the values and aspirations of ODM’ when they have no basic knowledge of the Constitutive Document Document of the party and is indicative of just how far they have drifted from the mother ship,” the letter addressed to their lawyer Kipchumba Murkomen reads.

He further noted that the sections quoted by the two MPs in their appeal do not exist in the party’s Constitution.

The two MPs filed an appeal contesting their expulsion claiming that the decision was made in “complete disregard” of the party Constitution and was based on allegations that are “strange and not recognised by any law.”

They have been accused of openly supporting and promoting the interests of another political party, following their public association with Deputy President William Ruto.

They, however, argue that their association with DP Ruto is in line with the Building Bridges Initiative which is fronted by their party leader Raila Odinga alongside President Uhuru Kenyatta.

“An allegation that the Hon. Members supported a ‘presidential candidate’ other than ODM party presidential candidate is baseless and outrageous. No party has nominated such a candidate as at the time of the alleged utterances or even now for the future elections. That nomination is yet to come,” they said.

The two lawmakers further accuse the party disciplinary committee –composed of five members— of making the decision to expel them the onus of one member.

They further claim that the decision was then communicated to the ODM National Executive Council (NEC), which according to them was not properly constituted.
