Ousted Nyeri TNA MCAs File Appeal Against Ruling

Mary Wairimu, Joseph King’ori and Regina Wanjiru all nominated by the TNA party have filed the appeal under certificate of urgency before Justice James Wakiaga of Nyeri High Court.

 

The three have challenged the judgement by Chief Magistrate Wilbrodah Juma delivered last week on Thursday which ruled that nomination of 13 TNA MCAs in the county was invalid and ordered a fresh exercise.

 

In the appeal, the three want the High Court to issue stay orders restraining execution of the judgement.

 

The embattled MCAs have argued that they were nominated to represent the marginalized and people with special interests.

 

The MCAs have faulted the court’s decision on six grounds and have expressed confidence in the success of their appeal that raises valid questions of law regarding the judgement.

 

Through lawyer Ngunjiri Maina, the MCAs are contending that if the ruling is executed, they stand to suffer a substantial loss including losing their seats, positions and privileges at the County Assembly.

 

The lawyer applied for orders enjoining the County Assembly Speaker, David Mugo as a party in the appeal.

 

Maina further sought orders to restrain TNA party from conducting fresh nominations and IEBC be restricted from declaring or gazzetting the appellants’ positions vacant.

 

The appeal will be heard on June 20 this year.
