Parliament wants Namwambas Reinstatement Suit Dismissed

The High Court has been asked to dismiss a case filed by former Public Accounts Committee (PAC) chair Ababu Namwamba seeking reinstatement.

The Budalang’i MP and Orange Democratic Movement (ODM) Secretary General had sued the Attorney General, National Assembly’s Privilege Committee and the clerk over his sacking as the chairman of PAC.

In an earlier ruling High Court Justice Weldon Korir could not issue order to stop the implementation of a report disbanding PAC over corruption allegations.

In his submission to the court, National Assembly clerk Justin Bundi, through lawyer Wangechi Thanji, said the application has been overtaken by events adding that a new chairman has already been appointed to take over the chairman role at PAC.

He further urged the court to drop the petition since it had no jurisdiction to rule on the matter adding that the court can only be involved if the Constitution has been breached.

Bundi also noted that the three arms of government should be allowed to executive their mandate without interference.

Namwamba had moved to seek the courts intervention in the matter and quashing of the decision made by Parliament to oust him from his chair position in the powerful committee.

Through his lawyer Isaiah Mandala, Namwamba told the court that the process leading to the reconstitution of PAC as well as the matter of reconstitution contravened the provision of the law and standing orders.

He also noted that his names had been tainted by the allegations against him by “malicious individuals who have since withdrawn the allegations and apologized”.
