Police officer accuses lawyer of conning him in Ksh.6M insurance case

A  Kilifi-based police officer is seeking justice after a lawyer allegedly conned him in a case he had filed claiming compensation from an insurance company after his wife died in a road accident.

According to the officer, Emmanuel Kiti Chiboe, his wife was involved in a fatal road accident along the Kilifi-Malindi highway in 2012. He claims the insurance company under which the public service vehicle (PSV) involved in the accident was insured was capable of compensating him.

Speaking to Citizen Digital, the officer said he filed a case through his lawyer seeking the court to order the insurance company to compensate him but the advocate has allegedly been undermining the case.

Chiboe said the case has dragged since 2013, without any hope of him getting justice alleging that the lawyer never presented the case in any court of law.

“After the accident, I buried my wife Sylvia Jelatgat Sesa then (24 years) later I decided to sue the driver and the PSV vehicle over reckless and careless driving. My lawyer whom I had trusted never took the case to court, he first requested for Ksh.200, 000 to file the case but I declined. Following the disagreement over the money, he went silent, 6 years down the line I see darkness,” said Chiboe.

He added that he was expecting around Ksh.6 million as compensation, if the case had followed the right track. The officer, however, says his lawyer had been frustrating him by not picking his calls or replying to his texts messages, making him suspect that something fishy might have happened between the lawyer and the insurance company.

“I have been devoting using my own resources to proceed with the case. I am suspecting something fishy happened between him and the insurance company,” he stated.

He also said that he had tried seeking for more information from the insurance company but they declined his request citing that they were only dealing with his lawyer.

“I call upon the DPP, DCI and the EACC to intervene over this matter so that justice could prevail, I am exhausted and I cannot persevere the pain anymore,” he remarked.

Efforts to reach out to the lawyer were futile as his phone number failed to go through and his office remained closed.

Currently, Mr. Chiboe is married to another wife and attached to Adu Police Station in Magarini Sub- County in Kilifi County.
