Police ordered to arrest Defence PS Kaberia

The High Court has given the police one more chance to arrest Defense Principal Secretary Kirimi Kaberia for failing to compensate a former army officer and produce him before court on November 9, 2016.

The court was told by the police that they have been unable to arrest Kaberia, who was expected to appear in court today (Monday) following an arrest warrant issued on October 10.

Judge George Odunga extended the warrant of arrest, and directed that the officer charged with the enforcement of the warrant be facilitated to carry out his job.

Kaberia’s arrest warrant was issued after he failed to appear before court in a case where he was accused of failing to compensate Silvanus Odiaga Ksh5 million.

In the case, the former army officer argued that the accounting officer in the Defense ministry had declined to comply with orders directing that he (Odiaga) be compensated for unlawful termination – orders that were issued in July 2014.

Odiaga was accused of incurring irregular expenses. Although he was acquitted of some of the allegations, a investigations team found him guilty of flouting procurement regulations.

His appeal was not considered, eventually forcing him to retire on pension in September of the same year.

Odiaga sued the government, arguing that his termination was unlawful.

Justice Linet Ndolo of the Labour court ruled that his superiors mishandled his case further setting aside the criminal proceedings.
