Politician gets 15 years in jail for defiling minor

A Member of the County Assembly (MCA) has been jailed for 15 years after he was found guilty of defilement.

Ntimaru East MCA, Masa Hura, was sentenced to 15 years in jail by a Migori Court after he was found guilty of defiling a 13-year-old standard six pupil.

The court heard that on diverse dates in May 2014, Mr Hura defiled the minor in a lodging within Ntimaru East Ward in Kuria East Sub County.

High Court Judge, Anthony Murima, dismissed an appeal filed by the MCA challenging the sentence, which had been given by a Magistrate Court, saying that the offence warrants such a sentence.

He, however, has 14 days to appeal the High Court decision at the Appeals Court in Kisumu if not contented with the verdict.

The minor, in her previous testimony, told the court that she had gone to buy charcoal and vegetables from the market when the MCA dragged her into a lodging.

Hura, in his submission to the court, said he was at home celebrating a newborn son, the day the crime was committed.

In her judgment in January 2015, Rongo Senior Resident Magistrate, Purity Rugut, said that the hospital medical result, which was done by a clinical officer at Kehancha District Hospital, showed that the girl was defiled and so found the MCA  guilty  and he was convicted under Section 8 (1) (4) of the Sexual Offences Act.

The MCA has been out on bond of Ksh 1 million.
