Rai Cement boss murder: Three suspects freed, 3 charged with robbery with violence

Three out of the six suspects who had been arrested in connection with the murder of Rai cement factory manager Chetan Vyas early this month have been unconditionally acquitted by a Kericho court over insufficient evidence.

The trio; Osman Noor aged 24, Shabdin Ismail aged 38 and 24-year-old Yacob Ali were acquitted by on Monday by Kericho Chief Magistrate George Kimanga after the prosecution failed to link them to the killing.

However, three other suspects; Daniel Ruto, Michael Nicholas Mibei and Hilary Cheruiyot  Kemboi, were charged with robbery with violence.

According to the charge sheet seen by Citizen Digital, the three were charged that on the night between September 22 and 23 at Rai Cement Company Limited in Kipsitet area in Sigowet/Soin  Sub-county within Kericho County they robbed Chetan Vyas of his mobile phone and five suitcases with assorted items of unknown value.

The charge sheet further indicated that the accused “at or immediately before or after such time of the robbery they used physical violence which caused the death of the said Chetan Vyas.”

One of the suspects, Nicholas Michael Mibei, was also charged with an alternative charge of handling stolen goods contrary to section 322(1)(2) of the Penal Code.

He was charged that “on October 5, 2019 at Ngomwet village in Soin-Sigowet sub county within Kericho County, otherwise than in the cause of stealing, dishonestly retained an Airtel card having reason to believe it to be a stolen good.”

They denied all the charges and were detained pending a ruling on their bail application on Tuesday.
