Relief as court halts evictions in Mukuru kwa Njenga

Over 800 families families residing in Mukuru kwa Njenga slums, Nairobi County can breathe a sigh of relief after the High Court on Friday issued an injunction barring Orbit Chemical industries from evicting them.

In the ruling, Senior Principal Magistrate Ayuma M’mmasi directed that both parties file their responses which  would be heard on July 11,2019.

“Both parties have filed application with this court. We will give each part 21 days to respond to the applications filed against them. The matter will proceed on July 11,” read the ruling in part.

This comes after Nairobi County through their lawyers, filed an application seeking a case by Orbit Chemical Industries to evict the residents from the disputed piece of land in Embakasi be dismissed.

In their arguments, lawyers representing Nairobi County said that the application by Orbit Chemicals Industries lacked merit.

Further, they argued that their application failed to demonstrate its propriety interest over the law suit.

” The motion is an abuse of court process, ” argued the county.

In their application, Orbit Chemical Industries wanted to be issued with orders to eject families squatting on a road reserve to allow them to have access to their parcel of land.

Nairobi County who were enjoined as an interested party in the matter however objected.
