Remaining Patel dams yet to be audited, says MCA as he sues owners

Kabazi Ward Representative, Dr. Peter Mbae, has moved to the Land and Environment Court in Nakuru over failure by the government to audit the remaining six Patel dams in Solai.

Dr. Mbae has sued the Water Resource Management Authority (WARMA), National Envrironment Management Authority (NEMA), National Water Conservation and Pipeline Corporation, Tindress Patel Coffee Estate Limited and the Salt Manufacturers Company Limited for failure to also conduct an environmental impact assessment.

Under a certificate of urgency, he is seeking orders to have the remaining six Patel dams in Solai audited and an environmental impact assessment be done to ascertain their safety.

Through lawyer Bernard Kipkoech, the MCA claims that the Patel dams are not in good condition and that their status has not been made known to the residents and the public to avoid any possible danger.

“The remaining dams have not been audited and the situation is intense, the safety of our clients in the area is in dilemma and they fear for their lives,” said lawyer Kipkoech.

The Law Society of Kenya has been listed as an interested party in the case.

The court registry will allocate a date for the interparte hearing.
