Round one win for Sonko as court dismisses Kidero’s application
The High Court on Thursday dismissed Evans Kidero’s application to be enjoined as an interested party in an election petition challenging the election of Nairobi Governor Mike Sonko.
Through lawyers Harrison Kinyanjui and Cecil Miller, Governor Sonko had on November 13 urged the court to dismiss Kidero’s application, telling Justice Mbogholi Msagha that this was just a ploy by the former governor to file a petition using backdoor means.
Justice Msagha ruled that Dr. Kidero had enough time within which to file a petition but he did not, and further did not give satisfying reason why he, independently, chose not to challenge the election outcome within the set time.
Through lawyer Tom Ojienda, Kidero had argued that since the petition filed by a voter, Justus Maroka, was challenging the election of the Jubilee candidate, he too being an ODM candidate in the August 8 election has a personal interest in the matter.
