Ruling for Mwilu case on three-judge bench expected today

A ruling on whether the case in which Deputy CJ Philemona Mwilu is challenging her prosecution will be heard by a three judge bench or not is expected on Wednesday.

The High Court ruling will be delivered by Justice Chacha mwita who issued temporary orders stopping the prosecution of Mwilu.

The Director of Public Prosecution Noordin Haji wants the file taken to the Chief Justice to empanel a three judge bench to hear.

According to him, the case by Mwilu raises weighty constitutional issues that need to be addressed by a three-judge bench.
