Sarah Wairimu fails to take plea as Ombeta says Murgor is Prosecution counsel

Sarah Wairimu will again be remanded until Tuesday after failing to take plea following claims that her lawyer Philip Murgor is Prosecution counsel.

According to lawyer Cliff Ombeta, Murgor was appointed as a public prosecutor on January 19 this year for a period of two years.

“Is this not a matter of public interest,” Ombeta posed insisting that there is no Gazzette notice negating the fact.

On his part, Murgor responded saying he had wasted two months with no work assigned to him and subsequently resigned on March 7.

According to him, the revocation of a Gazzette notice is of no consequence.

“Ombeta should have filed a formal application challenging my position.This is all a distraction, a waste of time and an abuse of the process. It should not affect the plea,” the lawyer said.

Ombeta however maintained that if the Director of Public Prosecution Noordin Haji has not revoked the appointment, then Murgor should go to the Judicial Review Division.

High Court Judge Stella Mutuku ruled: “She (Sarah Wairimu) should be remanded until October 1 until the issue of representation is dealt with.”
