Serve parties in this case, Supreme Court to TSC

An appeal by the Teachers Service Commission (TSC) at the Supreme Court challenging its ruling directing the commission to implement the 50 to 60% salary increase for teachers has been accepted.

According to a letter by Supreme Court Judge Jackton Ojwang, the court directed TSC to serve the Kenya National Union of Teachers (KNUT) and three other parties before the case is heard.

The TSC appeal seeking Supreme Court to review its earlier ruling upholding the teachers pay hike is slated for September 9th even as the strike by teachers entered its third day.

On Tuesday, Treasury formally wrote to TSC saying it was unable to finance the 50-60% teachers’ pay rise awarded by the court.

Treasury said it could not borrow any money to implement the pay rise adding that borrowing to finance recurrent expenditure was against the Public Finance Management Act 2012.

According to Treasury, the additional requirement for eleven months of the Financial year 2015/2016 will be Ksh 20.1 billion, an amount that was not budgeted for.

“We believe that raising taxes to fund the award will have a negative impact on the growth of the economy and on jobs creation, and is therefore not advisable,” read the Treasury letter to the TSC.

“In view of the foregoing, the National Treasury is not able to provide the additional funding required to implement the salary award.”

TSC had initially filed a case in court seeking to block the reviewed salary for teachers, arguing it was not practical.
