Showdown looms as gov’t declares position on Miguna’s second return

A showdown is looming between the government and controversial lawyer Miguna Miguna who insists he will be returning to the country on Wednesday, May 16.

The government on Sunday reiterated its earlier position that Miguna is not a Kenyan citizen, hence, will only be allowed into the country using his valid Canadian passport.

In a letter to the Kenya National Commission on Human Rights, Immigration Principal Secretary Gordon Kihalangwa said Miguna must apply afresh to regain his Kenyan citizenship.

Kihalangwa said his department will not issue Miguna with a Kenyan Passport, since he has not applied for one.

The Immigration boss further insisted that the government will not purchase a flight ticket for the lawyer as demanded by his legal team, saying the court did not issue any order to that effect.

Last week, the Kenya National Commission on Human Rights wrote to the government asking it to purchase an air ticket for the deported lawyer, and issue him with a valid Kenyan passport to facilitate his return to the country next week.

KNHRC chairperson Kagwiria Mbogori also asked the Government to issue access cards to KNHRC commissioners so that they can meet and monitor Miguna’s return at the airport.

According to one of Miguna’s lawyers, Cliff Ombeta, the controversial lawyer is set to leave Canada on Monday, March 14 as he heads to Nairobi via Germany.

Ombeta said no communication or assurance has been issued by the government in regard to facilitating Miguna’s reentry.

“If they bring another problem, we will still have the same fights we had last time because its Miguna’s right to be in the country.  All these other things of insisting that Miguna must come in with a Visa is rubbish,” said Ombeta.

“There is a court order directing that Miguna should come in without any conditions.”

The fiery lawyer has since declared the day of his return via social media, demanding that he be issued with a valid Kenyan passport.

“I am returning to Kenya on May 16, 2018. I am a Kenyan citizen by birth. The High Court has ordered Fred Matiangi, Gordon Kihalangwa, Joseph Boinnet and Kinoti 13 times to issue me with a valid Kenyan passport and facilitate my return to Kenya as a Kenyan unconditionally.”

His attempted entry into the country two months ago was marred with controversy after he was detained at the Jomo Kenyatta International Airport (JKIA) for several days after he failed to surrender his Canadian passport for stamping.

He would later be deported to Dubai via an Emirates plane and emerge online claiming that he was drugged before being ejected from the country.

A series of court cases against the three top government officials bore no fruit leaving him with no other alternative but to head back to Canada where he has remained since then.
