Siaya Court upholds life sentence for a man in defilement case

A middle-aged man in Siaya County has been dealt a blow after the High Court sitting in Siaya upheld  a life imprisonment sentence that was slapped on  him by a Siaya Magistrate Court after he was found guilty of defiling a minor.

While delivering the ruling Thursday morning, Siaya High Court Judge Aaron Makau found the appellant George Ongule guilty of defiling a minor on the 1st May 2013 at Nywawara sub location, Gem Constituency.

“Considering the evidence provided by the witnesses and reviewing the prosecution exhibit, the court proved beyond reasonable doubt that the appellant defiled the minor contrary to Section 42 of the Sexual Offences Act,” said Justice Makau in his ruling.

He, therefore, dismissed the appeal, stating that the High Court established that the appellant was lawfully convicted to a minimum sentence of life imprisonment and, therefore, cannot interfere with the sentence.
