Sirisia MP John Waluke charged over Ksh.114M fraud case

Sirisia Mp John Koi Waluke has been arraigned in a Nairobi anti corruption court and charged with three counts of fraudulent acquisition of public properties and and forgery.

He is charged along side Grace Sarapay Wakhungu and Erad Supplies and General Contracts Limited in which its alleged they are directors.

The legislature is also accused of uttering a false document.

It is alleged that on February 24, 2009, being the director of Erad Supplies and General Contracts Limited he knowingly and fraudulently uttered a false invoice for the sum of USD 1,146,000 (Ksh.114.6million).

The money was to be used as evidence in an arbitration dispute between his company and the National Cereals and Produce Board.

It is contended that the uttered invoice was to be used to support a claim for cost of storage of 40,000 metric tonnes of maize that was incurred by Chelsea Freight.

The MP also accused in three counts of Fraudulent Acquisition of public property.

It is alleged that on different dates within Nairobi County, being a director of Erad Supplies and General Contracts Ltd, jointly with his Co-director Grace Wakhungu they acquired public property valued at Ksh.313million.

Wakhungu who did not appear before court will separately be charged with perjury, allegedly knowingly giving false testimony in the arbitration case between their company and NCPB.

The MP denied all the counts before Milimani Anti-Corruption Court Chief Magistrate Douglas Ogoti.

The Prosecution has asked the magistrate to consider the public interest in the case because the offense he committed led to the loss of millions of public funds and deny him bail and or bond.

The Prosecution advocate has also asked the court to issue warrant of arrest against Wakhungu who was not in court to take plea.

The court is expected to make a ruling on bail/bond application and issuance of warrant of arrest against Wakhungu at 2:00pm
