Sonko accuses MCAs of violating order stopping his impeachment

Embattled Nairobi Governor Mike Sonko is exploring all options to block his planned impeachment.

In a letter dated November 27 that was addressed to the Speaker of the Nairobi County Assembly, Sonko cited an existing order barring his removal from office.

On February 28 this year, Sonko through his lawyer Harrison Kinyanjui moved to court challenging impeachment proceedings against him.

The mover was Peter Imwatok who was the Minority Leader at the time.

On March 2, Justice Byram Ongaya directed that the impeachment proceedings be suspended until the matter is heard and determined.

Two days later, the respondents led by the county assembly filed a preliminary objection.

This coming Friday, Justice Ongaya is expected to give further directions on the first case that was lodged by Governor Sonko.

What remains unclear is the effect of the existing court order on the current impeachment motion.

Minority Leader Michael Ogada presented the motion and 86 members of the county assembly signed it.

Lawyer Kinyanjui has since written to the Speaker of the County Assembly questioning why they disregarded court order.

“By your purporting to process a fresh impeachment motion against Hon. Mike Sonko Mbuvi while these proceedings are pending, you have committed an act of intentional disrespect to these judicial proceedings…which constitutes contempt of court,” he said.

The county assembly speaker however insists that the court order will not have any impact on the current process since the mover of the motion and the grounds listed are different.

Governor Sonko’s legal team remains adamant that new motion is inadmissible since it breached the directions of the court and amounted to subjudice.

The Nairobi County boss is expected to appear before the county assembly next week to defend himself against the accusations leveled against him.

Thereafter, county assembly members will vote to approve or reject the motion pushing for his ouster.

If approved, the governor’s fate will then lie with the Senate, not forgetting the prevailing political situation.
