Sonko back to court to challenge clearing of Nairobi County boss

Nairobi Senator, Mike Sonko, has filed a notice of appeal at the Court of Appeal challenging High Court ruling that quashed criminal proceedings against Nairobi County Chief of Staff, George Wainaina Ndungu.

In his petition, the Senator says that he is dissatisfied with the ruling.

On Tuesday, July 18, the High Court ruled that charges leveled against Wainaina were an abuse of the court process and the criminal justice system.

High Court Judge, Joseph Onguto, further prohibited the Chief Magistrate’s court from continuing with the criminal trial which commenced early last year.

The Judge agreed with submissions issued by Wainaina that the role of Senator Sonko in the investigations leading to his arrest was more than that of a complainant.

The Chief of Staff at the Nairobi County Government was charged with offense of attempting to bribe the Senator with Ksh 1 million in a bid to induce him to drop a suit he filed over Loresho land owned by Nairobi Water and Sewerage Company.

Wainaina has been accused of irregularly allocating the land to a private developer.

Wainaina later moved to the High Court to challenge his prosecution on grounds that at the time EACC recommended his prosecution there were no Commissioners or Chairperson in office.
