Spencer’s forgery case in Ksh.500M Karen land saga to be withdrawn

The Prosecution has applied for the withdrawal of a criminal case against a Nairobi lawyer charged with five counts of forgery over a piece of land in Karen valued at Ksh.500million.

During the hearing of the case, the Prosecution said they had received new evidence that they intend to use.

“Following arraignment of lawyer Guy Spencer, we have receive new evidence from the persons who were supposed to record statements,” the court was told.

However, the complainant, Agnes Mugure, who was ready to testify in the case was stood down after the Prosecution presented their application to withdraw the case.

Spencer is also accused of demanding property upon forgery of testamentary instrument.

The court heard that on October 20, 2013, at the High Court of Kenya in Nairobi, the accused filed a forged will of Roger Bryan Robson with intent to defraud.

Robson passed away in 2012 and left his last will with Spencer who was his lawyer then.

The controversial advocate allegedly committed the act with intent to obtain a grant of probate in the matter of the estate of Mr Robson in succession cause No. 955 of 2013.

The complainant accused Spencer of forgery saying she had bought the piece of land in question from Mr Robson for Ksh.100million in 2011.

The matter will be heard on July 19, 2018.
