SRC fights court order suspending MPs salary cuts

The Salaries and Remuneration Commission (SRC) now want temporary orders suspending implementation of the new salary perks for MPs and state officers set aside.

SRC has faulted PSC’s case claiming that it obtained the order without disclosing to the court that the issues complained of had been addressed before the new perks were agreed upon.

“By virtue of this non disclosure of material facts and concealment of relevant documents the ex-parte orders issued on the 14th of December ought,in the interest of justice be set aside,”said SRC

The commission claims that there was public participation and that various communication were held between SRC and PSC subsequent to the gazette notice been published.

“The application filed by Parliamentary Service Commission is misconceived and an abuse of court process,”reads the court papers

Further SRC says that it took account on all matters in law.

They now want the order issued in December by Judge George Odunga lifted pending determination of a case by the Parliamentary Service Commission (PSC) contesting pay cuts of its member’s .

SRC, claims that if the order remains in force PSC will proceed to remunerate its employee’s on irregular terms which if effected , the sums will be irrevocable should the court uphold the decision to reduce MPs salaries.
