Supreme Court upholds Kilogoris MP Konchellas poll victory
The Supreme Court on Friday overturned a Court of Appeal ruling and upheld the election of Kilgoris Member of Parliament Gideon Konchella.
This comes after a July 31 ruling by the Appellate Court that nullified Mr. Konchella’s election victory saying the petitioner – Julius ole Sunkuli – had proved that there was an alteration of election results in two polling stations.
Court of Appeal Judges Asike Makhandia, Daniel Musinga and Gatembu Kairu faulted a prior decision by High Court Judge Martin Muya that upheld Mr. Konchella’s win saying several complaints were not addressed before delivering the judgement.
According to a previous article published by the Daily Nation, the trio listed some of the complaints as “absence of data entries in Forms 35B for some polling stations, bribery, non-identification of voters in some polling stations, announcement of results without Form 35As and preparation of such forms without data.”
The petitioner, Mr. Sunkuli, is a former Cabinet minister and former ambassador to China.
