Suspended Chiloba back at IEBC

Employment and Labour relations court in Nairobi has temporarily recalled IEBC CEO Ezra Chiloba from compulsory leave.

The ruling, made by Justice Stephen Radido allows Chiloba, who was suspended in April by IEBC chairman Wafula Chebukati to continue with his duties pending hearing and determination.

Chiloba had filed a petition challenging the decision by Chebukati to send him on a 3-month compulsory leave in what was said was as a result of “procurement issues.”

In his ruling, the judge maintained that IEBC did not follow the law in sending Chiloba on compulsory leave.

“In view of the court, it would not be proportionate and in public interest to uphold a decision taken without legal or contractual foundation by an employer,” ruled judge Radido.

In his suit papers, Chiloba contends that the decision by the IEBC chairman to send him on compulsory leave was “wrong, unconstitutional, malicious and did not follow any lawful procedure.”

The move to suspend Chiloba, sharply divided the commission with some reported to have stormed out of the meeting called to suspend the CEO.

Chiloba had tried to block his suspension in April but judge Radido declined to grant his request saying he needed to to hear all parties and facts of the case first.
