Teacher jailed for ten years for indecent act on pupil

A primary school teacher was sentenced to 10 years in prison by a Nakuru court on Wednesday for committing an indecent act with a minor in 2012.

The accused, Daniel Kirui Njuguna, was convicted of ejaculating on a minor’s uniform with intent to defile.

Mr. Njuguna had been charged with attempted defilement with an alternative count of committing an indecent at with a 7-year-old pupil. He was however acquitted of attempted defilement by the court after prosecution failed to prove contact, as is required in law.

Senior Resident Magistrate Yvonne Khatambi committed the accused to 10 years imprisonment, saying said that all the witnesses who testified in court gave corroborating evidence that was consistent in their statements.

“The prosecution has proved beyond reasonable doubt that the accused committed the act,” said the magistrate while reading her judgment.

The court heard that on March 9, 2012, the accused committed an indecent act by ejaculating on the minor’s uniform with intent to defile.

The incident occured inside a matatu along the Nakuru-Nairobi highway.

According to the minor who testified in court,  the teacher offered to carry her on his lap since the vehicle was full when they were traveling back to Nakuru from a school trip in Nairobi.

She added that the teacher later told her to turn where he unzipped his trouser and later ejaculated on her.
