TNA clears MP Moses Kuria of incitement

The National Alliance Party (TNA) has acquitted Gatundu South Memeber of Parliament Moses Kuria of incitement charges saying the video allegedly showing him inciting residents of Gatundu did not give conclusive evidence and is thus unreliable.

The TNA disciplinary committee had been hearing Kuria’s case, which threatened his suspension or expulsion from the party, but now says the complainant TNA Chairman Johnson Sakaja did not provide the whole 41-minute footage to prove that Kuria’s remarks were not maliciously edited.

Kuria has, however, been given 14 days to clarify to the people of Gatundu what the remarks meant and thirty days to publish a similar clarification on the local dailies.

The Gatundu South legislator, however, still faces incitement charges in court.

Last month, the Milimani Law Court summoned the Gatundu South Member Parliament over allegations of hate speech.

The legislator is being accused of making inflammatory remarks during a rally in his constituency where he told residents to take up pangas and slash anyone who opposes the National Youth Service (NYS) project.

The order came just a day after the National Alliance party (TNA) summoned the Gatundu South MP to the party’s disciplinary committee over the allegations of incitement to violence.

The National Cohesion and Integration Commission (NCIC) had also written to the Chief Justice, Inspector General of Police and the Director of Public Prosecutions (DPPs) seeking action to be taken against Kuria.

Kuria had earlier been grilled by the Directorate of Criminal Investigations (DCI) officers at the CID headquarters over his remarks.

According to NCIC chairman Francis Ole Kaparo, Kuria’s comments are reason enough to have him behind bars.

The Director of Public Prosecution (DPP) Keriako Tobiko also added that he had made an application of urgency to the court seeking the cancellation of Kuria’s bail that will see the him face further charges for separate criminal offences  relating to his latest utterance.
