Tob Cohens body will not be released to anyone else except Sarah Wairimu lawyer

The body of the late Dutch businessman Tob Cohen can only be released to his wife Sarah Wairimu Cohen, her lawyer has said.

Speaking outside the Chiromo mortuary where the postmortem was being conducted, Philip Murgor revealed that his client has demanded that after the exercise, the body of the late Cohen not be released to anyone else.

“The notion that the sister is entitled to the body is alien in the Kenyan Law….. Sarah is innocent under the Kenyan Constitution and nothing has happened so far to take away her right to her husband’s body,” Murgor said on Wednesday.

Murgor criticized Cohen’s sister for indicating that she would be burying the body under Jewish custom.

In a letter seen by Citizen Digital, the lawyer further indicates that Wairimu is still lawfully married wife to the late Cohen.

He maintains that she is innocent until proven guilty.

“What we have is a charge which shall be dealt with in court but the act of being charged does not take way the right of a wife to a husband’s body and the right to bury it with the dignity deserved,” he added.
