Turkana Leaders, Residents Sue Govt Over Insecurity

The move by the two leaders brought to 28 the number of Turkana County residents enjoined in the petion that has been filed in collaboration with the County Government of Turkana.

Turkana residents took the National Government to court accusing it of failing to ensure them of their security from internal and external aggressions.

The Attorney General, through Advocate Kuria Kanyingi, was of the opinion that the matter be settled out of court given that the case is between the National Government and the Turkana County Government.

Justice Isaac Lenaola, however, advised that the parties in the matter first file replying affidavits and other court documents before he could issue any orders to determine the way forward.

The case will be mentioned on April 7th to confirm compliance by the parties.

The petition is the first of its kind and policy makers argue that it may open a floodgate of similar cases with several places in the country especially in the north, living with perennial insecurity problems.

INDISCRIMINATE KILLINGS

In the petition, the residents and the Turkana County government want the court to order the Ministry of Internal Security to immediately mobilize security agencies from the National Police Service (NPS), Kenya Defence Forces (KDF) and National Intelligence Service (NIS) to protect their borders and prevent what they say is the invasion of their territory by bandits from neighbouring West Pokot and Baringo counties.

The residents and the Turkana County government say they have suffered indiscriminate killings of citizens, theft of livestock and destruction of property in violation of their fundamental rights.

They also want the government to evict what they say are raiders from Baringo and West Pokot counties who have occupied Turkana County.

The petition also seeks to compel the national government to bring to an end the incessant raids that are done in Turkana.

The cattle rustling menace in the three counties of Turkana, West Pokot and Baringo has seen communities lose hundreds of lives, livestock and property with each side claiming to be the victims.

The situation has worsened with authorities admitting that over 200,000 guns are in illegal hands in the region.
