Turkish national in multi-million shilling property tussle demands action

A Turkish national wants police to launch investigations against directors of a local company – – Velos Enterprises Ltd – – whom he accuses of orchestrating an incident where he was assaulted in Nairobi.

Mr. Bulent Gulbahar is embroiled in a property tussle with Velos Entrprises Limited and its Directors Ramesh Jayantilal Sheth, Ashok Jayantilal Sheth (Modern Lithographic Ltd) (Modern Lithographic Ltd), Jatinder Singh Mehta and Ravinder Singh Mehta (S.S. Mehta & Sons Ltd).

He claims that in 2006 he gave the said directors Kshs 56,500,000.00 (today’s value Kshs 500,000,000.00) for the Office Block 1C including 929m2 land at Gateway Business Park along Mombasa Road.

According to the Turkish national, he also paid the purchase price in full to Velos Enterprises Limited pending subdivision and issuance of a separate Title for my property as agreed in the Agreement for Sale.

However, the Velos directors have allegedly declined to honour the agreement.

“Over the course of the next 4 years i.e period from 2006 to 2010 Velos Enterprises Limited would present numerous excuses as to why they could not subdivide the property, as per the Agreement for Sale, and issue a separate Title for our Property,” said Mr. Gulbahar in a statement issued Friday.

This prompted him to move to court and on November 2015 Justice Ogola gave his Judgment by ordering Velos Enterprises and its Directors among others to issue a title within 30 days and also pay Ksh. 1,178,000.00 every month after the elapse of the 30 days.

The directors have allegedly never honoured the agreement.

He moved back to court and on February 18, 2019 Justice Grace Nzioka ruled in his favour ordering the said directors to deposit Ksh. 60 million in a joint account and return to court on March 5, 2019 for confirmation of compliance.

Before going back to court on March 5, the Turkish national says he went to Gateway Business Park to confirm whether Justice Ogolla’s orders had been met only for the security guards to forcefully block him and his lawyer from accessing the property.

“Upon arrival at Gateway Business Park my lawyer introduced us to Guard No 1 and explained to him the purpose of our Visit. Guard No 1 stated that he would need to get approval from the Caretaker of Velos Enterprises and walked away. While waiting for the return of Guard No 1, Guard No 2 approached the Vehicle and also sought the purpose of our visit. My lawyer Ataka also informed Guard No 2 on the purpose of the visit. After waiting for 25 minutes at the Gate, my lawyer Ataka approached the Gate to have further discussions with Guard No 1 and Guard No 2.”

“The discussion erupted into an argument and the Askaris started to “mandhandle” my lawyer Ataka. So I pulled him back and started pushing the gate with my bare hands. Upon pushing the Gate open Guard No 2 put his leg up on my path and made me fall and immediately thereafter descended upon me. I got up on my feet and started defending myself. You may take a men’s money but never try to take his honour and dignity, ” says the Turkish national.

He is now demanding action against the said directors over the alleged contempt of court and assault incident.
