President Uhuru Kenyatta faces an anxious two days to find out if he will be sworn in for a second term or his win in the October 26 repeat presidential election will be challenged at the Supreme Court.

Monday (November 6) is the constitutional deadline that a petitioner can move to the apex court to challenge his triumph over National Super Alliance (NASA) leader Raila Odinga who boycotted the repeat poll citing unwillingness by the electoral commission to effect changes to its personnel and operations to guarantee a credible repeat election.

Article 140 of the constitution states that “A person may file a petition in the Supreme Court to challenge the election of the President-elect within seven days after the date of the declaration of the results of the presidential election.”

Citizen Digital has however learnt that three NGO’s Kura Yangu Sauti Yangu,Muslims for Human Rights (MUHURI) and Katiba Institute might move to court to contest President Kenyatta’s win on Monday.

This comes even after Independent Electoral and Boundaries Commission (IEBC) chairperson Wafula Chebukati gazzetted President Kenyatta and his Deputy William Ruto as President and Deputy President-elect on October 30.

President Kenyatta was  declared winner of the October 26 repeat poll after garnering 7.4 million votes representing 98% of the total votes cast.

This was his second win after the Supreme Court nullified his win in the August 8 election citing massive illegalities and irregularities.

In his acceptance speech on Monday shortly after being declared winner President Kenyatta urged NASA to move to court to seek redress.

“Let them (opposition) first exhaust the constitutionally laid out processes, let them go to court, let them do whatever they want. Nobody shall deny them of their constitutional right. As to my agenda going forward, I will discuss once the processes (legal battles) are over,” said Kenyatta at Bomas of Kenya.

The repeat poll was marred by low voter turnout.
