Victory for Mvurya as court upholds win

A High Court in Mombasa has struck out the election petition against Governor Mvurya over failure to include Deputy Governor and indicate poll results in papers filed by a voter.

While delivering her judgment, Lady Justice Mugure Thande termed the petition as “incompetent” saying it did not meet the petition rules.

Lady Justice Mugure faulted the petitioner, Mwamlole Tchappu Mbwana for failing to enjoin Deputy Governor Fatma Achany who was elected on a joint ticket with Mvurya in her petition.

She further ordered Mr.Mbwana to pay 2.5 million shillings which is the cost of the case.

Mr. Mbwane had moved to court to challenge Mvurya’s re-election saying that his election on August 8 was “marred with irregularities.”

He wanted the court to nullify Mvurya’s win.

However Mr. Mbwana’s lawyer,Anthony Wasuna has however said he will appeal the decision claiming that the judge did not follow the law when making her judgement.

Salim Mvurya was reelected for a second term in office on a Jubilee party ticket after garnering 119,680 votes beating Wiper’s Chirau Ali Mwakwere who garnered 29,741 votes.
