Waiguru free to comment on NYS scandal in media, court rules

The magistrate court has dismissed an application by 11 suspects in the Ksh.791 million National Youth Service (NYS) theft scandal that sought to have the court bar former Devolution Cabinet Secretary Anne Waiguru from making comments relating to the case in the media.

The court ruled that the application by the suspects has no merit, adding that there was no evidence produced in court to show that the former CS was making such comments as alleged by the suspects.

Magistrate Martha Mutuku also declined to quash summons issued to the suspects to appear before the National Assembly’s Public Accounts Committee saying that there was no proof or letters presented in court to show that they had been summoned.

They had argued that the decision by PAC to summon them would be double jeopardy, adding that the committee is subjecting them to a second defense as they were already standing trial in a criminal court.

The matter will be heard on November 17, 2016.
