Waiguru threatens to sue King Kaka, demands ‘Wajinga Nyinyi’ song pulled down

Kirinyaga Governor Anne Waiguru has threatened to take legal action against King Kaka should the popular rapper fail to take down his latest sensational song dubbed ‘Wajinga Nyinyi.’

Waiguru, in a demand letter through lawyer Paul Kiragu Wathuta, accuses the musician of uttering allegations and innuendos against her which have resulted in gross misrepresentation of facts and deliberate mischaracterization of her conduct.

According to the governor, the song contains references to her which are malicious and reckless with complete disregard of the loss or damage occasioned to her.

Governor Waiguru, in the letter, cited the following lyrics from ‘Wajinga Nyinyi’;

“Ati Waiguru ako kwa office na story ya NYS tulishasahau

Biro moja alibuy 8 thao, biro tunanunuanga mbao

Either sisi ndio wajinga ama ako na marking scheme ya Accau…”

The Kirinyaga County boss stated that the above lyrics implied that she is corrupt, was involved in theft of public funds at the National Youth Service (NYS) and irregularly purchased items – such as biro pens – at overpriced prices while at the helm of the Ministry of Devolution.

“You know or ought to have known our client is a national leader who has served Kenya in senior capacities and was duly elected by the people of Kirinyaga County on her merits and that such lyrics have greatly lowered the regard and esteem in which our client is held by right thinking members of the public of Kenya and abroad and not to mention in the eyes of the numerous persons with whom she interacts in the course of her public duties as the Governor of Kirinyaga as well as her other public and private life,” read the letter.

“You know or ought to have known that despite extensive investigations and several prosecutions in relation to the loss of funds at NYS, our client has never been charged in a court of law as an accused person in relation to the NYS or any other scandal.”

Waiguru also added that she publicly demanded investigation into the NYS scandal and that there has been no evidence of her culpability, and that she was cleared by the Public Accounts Committee’s investigations.

She also stated that King Kaka’s main motive of releasing the song was to increase his popularity, Twitter following and enhance the profits to be made from its publishing.

“To the best of our client’s knowledge, you have never recorded any statement with the Directorate of Criminal Investigations or the Ethics and Anti-Corruption Commission regarding the allegations that you have made…” added the letter.

Waiguru now wants King Kaka, real name Kennedy Ombima, to offer an apology to her, pull down the song from all social media platforms permanently and to commit  in writing not to release any further defamatory songs against her; all within 48 hours.

Failure by the artist to adhere to the said conditions, the Kirinyaga governor stated that she will head to court to seek injunctive orders restraining King Kaka from further distributing any defamatory lyrics against her, closure of his Twitter account, as well as that he foots costs of the suit.

King Kaka has evoked mixed emotions online since the release of his piece ‘Wajinga Nyinyi’ on December 14. The song takes on societal ills brought about by the ruling political class.
