Cabinet Secretary Anne Waiguru has threatened to sue CORD leader Raila Odinga for linking her to the sh791 million scandal at the National Youth Service (NYS).

Through her lawyers, Mohammed Muigai advocates, the devolution and planning cabinet secretary demanded an unconditional apology from Odinga.

However, the CORD leader has said he will not apologize and he has challenged Waiguru to go to court.

Odinga alleged that the name of Waiguru was purposely deleted from the ‘list of shame’ released by the Ethics and Anti-Corruption Commission (EACC) in March this year.

Odinga claimed that the list originally submitted to President Uhuru Kenyatta is different from what was tabled in Parliament, saying that it was doctored to favour Waiguru.

He further told off Waiguru over demands for an apology that she had sought on grounds that he had defamed her by referring to her as corrupt.

His remarks against Waiguru, he said, if defamatory or not are true and he will defend them in any court of law.

Odinga wanted the EACC and other state agents to carry out a thorough probe on the NYS saga and prosecutions of those found guilty effected immediately.

In a statement sent to newsrooms, Tobiko noted that several aspects of the fraud case fell under the Ethics and Anti-Corruption Commission (EACC) and directed that the EACC be invited to join the prosecution team to participate in the review of the file in order to determine matters falling under its legal mandate.

Tobiko stated that he had received an inquiry file into the alleged fraudulent transactions from the Director of Criminal Investigations and that a team of prosecutors was currently reviewing the file and the review is ongoing.

“Given the nature, complexity and magnitude of this investigation, the CID investigation team has done a commendable job,” read the statement.

“The investigation carried out by the CID is limited only to offences under the Penal Code. However, the evidence in the file discloses possible offences under Proceeds of Crime and Anti-Money Laundering Act and the Prevention of Organized Crimes Act. These offences have not been investigated.”

Tobiko noted that from the evidence, huge deposits were made to and withdrawals made from bank accounts belonging to several suspect companies and individuals.
