Waititu ‘BabaYao’ finally raises Ksh.15M bail, freed after four nights in jail

Kiambu Governor Ferdinand Waititu has finally been released from police custody four days after he surrendered himself to the Ethics and Anti-Corruption Commission.

On Thursday morning, Waititu managed to secure his freedom after paying the Ksh. 15million cash bail.

The previous day, his lawyer Tom Ojienda sought to have the terms reviewed saying the amount was too high and tantamount to denial of bail.

The court had ordered that the Governor pay cash bail of Ksh.15 million and Ksh.30 million bond.

Waititu’s wife Susan Ndung’u was directed to deposit Ksh. 4million cash bail and a bond of Ksh. 10million or surety of a similar amount.

She paid the cash bail on Wednesday and was released after three days at Lang’ata Women’s Prison.

Waititu’s biggest headache now remains his deputy James Nyoro.

Following his boss’ arraignment, Nyoro publicly announced that he is now taking over the reigns for the period of the case.

On July 24, 2019, Judge Ngugi instructed that elected executives cannot continue to attend office when facing corruption related charges.

It is on this premise that Nyoro presumable assumed office citing the court’s orders that barred his boss from accessing Kiambu County offices.

However, the removal of a Governor is provided for in the constitution where impeachment is to be pursued in event that the county assembly no longer backs the county boss.

Waititu’s lawyers are expected to secure a date at the High Court to appeal Mugambi’s decision.
