Waititu sues Ngilu over incitement remarks

Kiambu Governor Ferdinand Waititu has sued his Kitui counterpart Charity Ngilu over her alleged incitement remarks that led to the torching of a lorry ferrying charcoal.

Mr. Waititu wants the court to restrain Mrs. Ngilu from issuing and making any inflammatory and inciting statements associated with charcoal business and its transportation pending the inter-parties hearing of the application.

The Kiambu governor also wants the court to order Mrs. Ngilu not to unnecessarily harass motorists in the pretext of enforcing the charcoal management, but be restricted to only use the due process provided by the law.

“Ngilu’s speech was directed to inciting or producing lawless action and indeed produced action and the said motor vehicles were burnt,” said the governor.

Waititu claims that motorists and businesses have suffered as a result of the roads being blocked and vehicles having their tyres deflated which is a violation of article 40(1) of the Constitution.

He further argues that there is nowhere in the Kitui County Charcoal Management Act that says that a vehicle carrying charcoal should be torched.

“This is a violation of article 39 and 47 of the Constitution,” he adds.
