Warrant of arrest issued against ex-NYS boss Harakhe, Noor

A Nairobi Court has issued warrant of arrest against former National Youth Service (NYS) deputy Director General, Adan Harakhe, and former tender committee chairman in the Ministry of Devolution Hassan Noor for failing to appear in court over the Ksh 1.6 billion NYS scam.

The two are part of the 24 Ministry of Devolution officials linked to the loss of the monies at the service.

They are facing eight economic related crimes charges together with former Devolution Principal Secretary, Eng. Peter Mangiti, former NYS Finance Director, Samuel Wachenje, and 18 others.

In the first charge, the 18 persons are accused of conspiracy to commit an economic crime by irregularly paying Ksh 47.6 million public funds to Blues Star Enterprises.

In the second charge, the former PS, Mangiti, is accused of abuse of office by executing the payment of the said amounts to Blue Star Enterprises.

Adan Harakhe, an AIE (Authority to Incur Expenditure) holder, is facing charge of irregularly executing an LPO (Local Purchase Order) to pay Blue Star Enterprises Ksh 47.6 million for the supply of “Automotive Engineering Training Materials to NYS.

In the fourth count, 12 persons of the tender committee at the Ministry of Devolution wilfully failed to comply with the Public Procurement Law. They are accused of approving restricted tender in purchasing automotive training materials while requirements of such restricted tenders were not satisfied.

In the fifth count, eight tender committee members are being accused of failure to comply with procurement procedures by approving the purchase of engineering automotive training materials without technical evaluation being undertaken.

Selesio Karanja, a supply chain assistant at the NYS, is accused of fraudulently entering the name of Dama Services Ltd in the tender opening register whereas Dama Ltd had not been approved for the tender to procure engineering automotive training materials.

Five persons, who are members of the tender evaluation committee at the Ministry of Devolution, wilfully failed to comply with procurement law by failing to undertake technical evaluation of the Blue Star Enterprises tender.

Among those facing the charges alongside Mangiti, Noor, Harakhe, and Wachenje are Ruth Njeri Kiiru, Salim Ali Molla, Kennedy Nyamao, Florence Bett, Betty Njoki Muriithi and Jennifer Muthoni Kinoti.
