Win for teachers as Supreme Court declines to rule on pay case

The Supreme Court has ruled that it has no jurisdiction to decide the case on teachers’ pay hike that was filed by the Teachers Service Commission (TSC).

Deputy Chief Justice Kalpana Rawal said the Court does not have the jurisdiction to overrule the Court of Appeal‘s decision ordering a stay on Industrial Court’s ruling that granted the teachers a pay increment of 50 to 60 per cent.

The ruling comes weeks after the Kenya National Union of Teachers (KNUT) threatened to call a nationwide strike if TSC does not effect the pay rise by September 1, 2015.

KNUT Secretary General Wilson Sossion said he had written to the Parliamentary Committee on Education over the looming strike when schools re-open if the government does not implement the revised August salaries.

In June this year, the Industrial Court awarded teachers a 50 to 60 per cent pay rise dating back from July 2013 to July 2017.

Judge Justice Nduma Nderi ordered that the pay increase agreement between KNUT and the Teachers Service Commission should be registered with the court within 30 days.

Despite protest from teachers’ union, TSC moved to the Court of Appeal seeking to stop the ruling.

Court of Appeal ruled that TSC should effect the pay pending the hearing of the case slated for September 22, 2015.
