Witnesses defend British lawyer Spencer in Ksh.500M Karen land case

Two advocates have defended British lawyer Guy Spencer Elms in a case involving a Ksh.500 million piece of land in Karen, Nairobi.

The two; Lilian lofty and Nafysa Adam, told the court that they were present prepared and witnessed the execution of the Power of Attorney (POA) relating to the prime property owned by the late Roger Bryan Robson who died in August 2012.

The lawyers were working at Raffman Dhanji Elms & Virdee Advocates at the time the POA was prepared in 2010 and where Guy Elms, who is accused of forging the said document, is a partner.

Lilian Lofty confirmed to the court that indeed she prepared the POA at the request of the late Bryan Robson.

Asked whether she had any documentation to support the aforementioned request, she said she received the instructions during a meeting with Roger.

On his part, Nafysa Adam told the court that she met Roger in 2010 and witnessed him signing the POA granting powers to Guy Elms to execute his wish.

A third witness, Brigitte Kosgey, a former administration officer at Old Mutual and a friend of the late Rogers, told the court that the deceased confirmed to her that he had appointed Guy Elms as the executor of his Will signed in 1997 and also issued him with a power of attorney.

She told the court Roger had told her he had no wife or children and his closest living relative was his brother Michael Robson who lived and still lives in England.

She confirmed that Roger was already suffering from health complications and used a walking stick as he was very weak and had trouble with his hands.

In the case, Nairobi businessman Agnes Kagure is seeking ownership of the prime property which she claims to have purchased from Roger Robson in 2011 for Ksh.100 million in cash before he died.

Kagure accuses Guy Elms of forging his client’s Will and POA in his efforts to transfer the property to himself.
