Woman seeks Ksh 4.8M compensation for alleged wrongful dismissal

A woman on Wednesday moved to a Nairobi court seeking Ksh.4,800,000 compensation from her former employer over alleged unjustifiable termination.

According to court papers, Nancy Wanjiku Kamau is a former employee at Kevian Kenya Limited where she served as Head of Sales since June 7 last year with a Ksh.400,000 monthly gross salary.

Ms. Kamau told the court that she was placed on a six-month probation after which she served on a permanent basis until her termination on April 12, 2019.

The company’s Managing Director, in a termination letter following an alleged review of her performance, reportedly stated that Ms. Kamau’s “results were unsatisfactory”.

However, in court papers challenging the dismissal, the claimant stated that at no time was she ever guilty of gross misconduct or inefficiency in performing her duties.

“The claimant avers that she worked diligently, loyally and was at all times dedicated to her job with the respondent,” read court papers.

She hence added that the process was un-procedural, unjustifiable, irregular and taunted with illegality and is therefore entitled to Ksh.4,800,000 for wrongful dismissal.
