Court adjourns Berardelli case, grants travel request
The case involving Italian athletics coach Claudio Berardelli and two co-accused has been adjourned to March 1 next year.
This comes after Senior Principal Magistrate Joyce Gadani declared during Thursday’s hearing that she would be unavailable to listen to fresh matters as she is being transferred from the Millimani Law Courts to Kibera Law Courts.
Berardelli – who is accused of administering prohibited subastabce EPO to three-time winner of the Boston Marathon and a two-time winner in Chicago Rita Jeptoo – also requested the court through his lawyer Juliet Jakaila to release his passport to enable him travel to Italy later tonight.
The court granted his request after admitting he would return to the country in January but instructed to hand in the passport back to the authorities.
The prosecution led by Senior Counsel Duncan Ondimu did not object to the request as long as Berardelli assured the court that he would return as stated.
“The first accused had been granted his request to travel. However he should deposit his passport back to the court February 2,” Gadani ordered.
Berardelli, who was arrested with fellow Italian sports coach Federico Rosa in July and later charged in August where they both denied doping charges leveled against them before being freed on a Ksh500,000 cash bail.
He is jointly charged alongside former local clinical officers Stephen Kiplagat Tanui alias Kalya and Daniel Cheribo Kiplangat with conspiracy to injure a person in their profession.
In the charges, the prosecution claimed that on diverse dates between August and September 2014 in Kapsabet Town within Nandi County, Claudio, Tanui and Kiplangat conspired to administer a prohibited substance in order to injure the profession of Jeptoo.
On Tuesday, Federico was set free after the State withdrew the doping charges against him with the Director of Public Prosecutions (DPP) saying no further investigations are set to be conducted on doping claims against the Rosa Associati Director.
