Federations propose suspension of Kipchoge, NOCK officials

The National Olympics Committee of Kenya (NOCK) affiliate federations have proposed the provisional suspension of seven NOCK officials.

In the Saturday morning meeting at a city hotel, the affiliate federations also proposed the formation of an Interim Committee to manage NOCK.

The Extra-Ordinary General Assembly meeting proposed the suspension of NOCK Chairman, Dr Kipchoge Keino, Secretary General, Francis K Paul and his assistant James Chacha, Second Vice Chairman, Pius Ochieng, Treasurer Fridah Shiroya and her assistant Stephen Arap Soi and Committee Member Anne Njamboi Maina under the amended Rule 9.1 of the NOCK Constitution.

The meeting, chaired by Waithaka Kioni of Kenya Volleyball Federation, resolved to suspend the operation of Rule 32.2 of the NOCK Constitution to enable them to protect the integrity and preserve the will of the members of the committee.

The rule states: “No amendments shall be proposed at a General Meeting unless the text of the amendment to be proposed shall have been furnished by the person intending to propose it, to the Secretary General, at least (30) days clear working days prior to the date of the meeting.”

“The meeting was inevitable, NOCK has 23 affiliate federations and each of those affiliates’ has suffered in one way or another under it. 19 federations out of 23 conveyed the meeting. We only missed Badminton and cycling federations,” said Kioni.

“It was in view of what happened in 2016 Rio Olympics not forgetting the London Olympics and the previous international events managed by NOCK.”

He added: “We have had very candid, open and honest discussions. The proposals have been made and have been supported by all the federations that present today.”

They further resolved unanimously to amend Rules 9.1 and 9.2 with immediate effect to insert the words “provisionally suspend” into rule 9.1 between the words “shall” and “send” such that the amended clause reads: “Whenever it shall appear, or if it shall be presented to the committee. By a requisition in writing signed by seven (7) or more Representative Members, that’s there is good and sufficient reason to believe that any member or Affiliated Body is guilty of misconduct, the Committee shall provisionally suspend and send to such Member or Body a statement in writing of the matters alleged and shall afford such a member or body the opportunity of giving and explanation.”

While in clause 9.2, the words “confirmed as” were inserted between the words “be” and “suspended” to read: “If, on the consideration of such explanation, or in the absence of such explanation being given within a reasonable time, the Committee shall be of the opinion that such Member, or Body ought be excluded from the Committee it shall state its opinion in the form of a report, whereupon such member or body shall be liable by resolution of the Committee to be confirmed as suspended or excluded as the Committee may think appropriate.” 

An interim committee was also elected which will liaise with the NOCK members who are not suspended and the Government in order to lift the disbandment and restore its functions.

The committee is also expected to review the NOCK Constitution and propose changes compliant with the Constitution of Kenya 2010, the Sports Act of 2013 and the Olympics Charter.

“We expect the committee to set a date for and organize free, fair and credible elections for NOCK before December 31, 2016. In the meantime, they will also engage IOC (International Olympics Committee) and inform them of the resolutions adopted be the General Assembly to return NOCK to normalcy,” said Nick Mwendwa, the Kenya Football Federation boss.

“Finally they shall be report back to us on their progress monthly. So we are kindly requesting the Government to lift the ban so that they can take over the management of NOCK.”

The eight member interim committee will be chaired Waithaka, while Andrew Mudibo of Kenya Table Tennis Association becoming the Secretary.
