FIFA threatens sanctions on Kenya over court case

FIFA has threatened to impose sanctions on Kenya should the High Court case challenging the composition of Football Kenya Federation’s (FKF) Electoral Board rules in favour of the petitioner.

This comes after the FKF wrote to the world governing body informing the Zurich-based body on the ongoing court case against the composition of the electoral body that wil conduct its December 7 polls.

In a letter sent to addressed to the FKF through Secretary General Barry Otieno, FIFA cited article 69 of the FKF Statutes, which prohibit submission of disputes affecting leagues, members of leagues to ordinary courts.

“FIFA takes this principle with the utmost seriousness and therefore considers that it is the responsibility of the member associations, including the FKF, to ensure that it is implemented at their level through a binding obligations on its members.

“We further wish to underline that a violation of this obligation by the FKF or its members may lead to sanctions as provided for in the FIFA Statutes, including a possible suspension,” FIFA’s chief members’ associations’ officer Veron Mosengo wrote.

The case at the Nairobi High Court filed by former FKF President Sam Nyamweya and George Mwaura wants Professor Edwin Wamukoya and Elynah Shiveka serve as chair and member of the board who respectively removed from the board.

“In this context, should the High Court of Kenya render a decision that goes against the aforementioned principle, the matter will be brought to the attention of the relevant FIFA bodies for consideration of suitable measures and possible sanctions in line with the FIFA Statutes.

“We thank you for taking note of the above and kindly request you to keep us informed about further developments in this matter,” FIFA wrote.

The sanctions by FIFA could included suspending Kenya from all international competitions.
