Sacked Miheso now demands over Ksh3.68m from Golden Arrows

National football team Harambee Stars winger Cliffton Miheso is demanding half a million Rand (about Ksh3.86 million) from his former club Golden Arrows of South Africa.

Through his lawyers, Wambilianga Majani and Associates, Miheso has sent a demand letter to Lamontville Golden Arrows on Tuesday, demanding compensation for “harassment, breach of contract and unlawful termination of contract.”

Miheso has put forward a case and his lawyer states that “That in blatant breach of the aforesaid contract, you failed, neglected and or refused to pay our client his signing bonus and his salary for the month of January,” read the demand letter sent to the chairlady of Golden Arrows Mato Madlala via email and courier.

“Further we are instructed that in blatant breach of Articles 13 and 16 of the FIFA Regulations on the Status and Transfer of Players as well as clause 18 of the contract, your club on the 14th of January 2017, frustrated the contract by unilaterally terminating the contract disregarding the right procedure as is stipulated in the contract,” his lawyer said.

The punch line and most incriminating part of the demand letter says; “We are instructed that your chief Executive Officer together with two gunmen violently forced and coerced our client to sign a document of termination of contract.

“That kind of termination shall not stand in law as it is pure intimidation, undue influence and /or duress as our client was induced to do so other than by his own free will.”

Miheso had to take refuge at the C R Swart Square Police Station in Durban on January 14 after an alleged gun drama at Arrows club offices where it is alleged that two gunmen forced his to sign a document he didn’t read.

Miheso recorded a statement with the Police who accompanied him back to Golden Arrows offices at the Moses Mabhida Stadium in Durban.

Miheso’s lawyers are demanding for general damages on top of payment of the remainder of his contract and unpaid signing on bonus, all totalling to 500 000 ZAR(5 million shillings) excluding the general damages.

Arrows have ten days to pay up or the case will be filed at the FIFA dispute resolution committee.

If the case goes to FIFA, Miheso’s lawyers are demanding payment of interest and sanctions upon the Premier Soccer League side in addition to unpaid salary and bonus plus damages.

Miheso is being represented by sports lawyer Elvis Majani of Wambilianga Majani and Associates.
