Wanyama sues Kenyan firm over image rights violation

Harambee Stars captain Victor Wanyama has moved to the Nairobi Milimani high court complaining about his image being used against his will.

The Tottenham Hotspur midfielder has sued Menengai Oil Refineries Limited for allegedly tweeting using his image.

Wanyama complains that the tweet was purported to wish Harambee stars well in the 2019 concluded African Cup of Nations Championship.

“If you believe it, you can do it, we at the Menengai would like to wish our boys all the best in the Africa Cup of Nations,” read the tweet which allegedly accompanied his photo.

Wanyama content that the tweet was meant to promote the company’s business and not to show support to team Kenya as purported.

“If the message was meant for the whole team,photo comprising the entire team could have been used,” continues the complainant.

The Stars captain therefore wants a court declaration that the actions of the respondent to use his image without his consent has contravened his image and personality rights.

He also wants the court to declare that the image published by Menengai Oil Refineries Limited constitutes a marketing advertisement.

Further, Wanyama wants the court to pronounce that he is entitled to damages from the respondent as a result of violation of his Image.
